The key point of the case was that Wang, the creator of AI-generated content, successfully upheld his copyright and received 4,000 yuan in economic compensation. The incident began when Wang published a note on the Xiaohongshu platform about his image works created using a 'certain AI' app. According to statistics, this note garnered widespread attention.

The Beijing Internet Court adjudicated a copyright infringement case involving AI-generated images, with the defendant ordered to compensate the plaintiff 500 yuan. The plaintiff used the open-source software StableDiffusion to generate the images in question and published them on the Xiaohongshu platform. The defendant used the images without permission in an article on Baijiahao, removing the plaintiff's signature watermark. The court determined that the images in question meet the definition of a work, qualifying as an artistic piece protected by copyright. The defendant infringed upon the plaintiff's right to attribution and their right to disseminate information via the internet.

The Beijing Internet Court has reached a first-instance judgment on the AI-generated image copyright infringement case, stating that AI-generated images possess originality and are protected by copyright law. When generating images, the intellectual contribution comes from humans rather than the model. As long as the human intellectual input reflects originality, it should be entitled to copyright.
